RENTAL AGREEMENT
TakeMeOverland Ltd.
This Agreement is entered into between the Renter and
TakeMeOverland Ltd. ("Owner") for the rental of the Vehicle described
at the time of booking (the "Rental").
By completing a reservation, the Renter confirms they have
read and agree to all terms and conditions below. The Renter is the designated
primary driver and accepts full responsibility for any damage or incidents that
occur during the Rental Period.
The Owner retains superior right of possession of the Rental
at all times. If the Owner determines the Rental is at risk of damage or loss,
the Owner has the right to recover the vehicle immediately, regardless of time
remaining in the Rental Period. Any costs associated with such recovery —
including travel, fuel, and repairs — are the Renter’s responsibility.
1. Rental Period
The Rental Period begins when the Owner hands over the keys
and possession of the vehicle to the Renter, and ends upon the completed return
of the vehicle to the Owner.
2. Authorised Drivers
The vehicle may only be driven by an authorised driver who:
• Holds a valid driver’s licence
• Has provided a physical street address
• Has agreed to the terms of this Rental Agreement
Any additional drivers must be pre-approved and meet all of
the above requirements.
3. Vehicle Operation
The Renter acknowledges that this vehicle handles differently
from a standard passenger car. Additional clearance, careful use of mirrors,
and direct visual verification are required at all times. Roof-top tents,
camping gear, and larger tyres increase the vehicle’s weight and extend braking
distance — this must be accounted for when driving.
Maximum permitted speed: 80 km/h.
The Renter and all authorised drivers agree not to operate the
Rental in a careless, negligent, reckless, or unlawful manner, and only on
public roadways with adequate width and height clearance.
4. Pick-Up
The Owner will ensure the vehicle is clean and in safe,
roadworthy condition at the time of pick-up. An orientation and driving lesson
will be provided.
Pick-up time: 3:00 PM. Early pick-up is available as an
add-on.
At pick-up, the Renter and Owner (or authorised
representative) will complete and sign the Departure Form, documenting any
existing defects or damage via written notes and/or time-stamped photographs.
5. Return
Drop-off time: 11:00 AM. Late drop-off is available as an
add-on.
A fee of $100 CAD will be charged for returns later than the
agreed time without an add-on.
Upon return, both parties must document the vehicle’s
condition via photographs taken no earlier than 24 hours before the trip starts
and no later than 48 hours after the trip ends. This is required for insurance
coverage.
6. Condition of the Rental & Damage Responsibility
In the event of any loss or damage to the Rental — including
from collision, rollover, theft, vandalism, fire, flood, hail, or other causes
— the Renter is responsible for paying up to the applicable insurance
deductible.
In the event of a repair claim, the Renter agrees to be
responsible for:
• The full cost of the repair
• Owner’s time at $50/hour
• Applicable taxes, fuel, and related expenses
7. Insurance
Third-Party Liability, Comprehensive, and Collision Insurance
is provided through ICBC (Insurance Corporation of British Columbia).
• Third-Party Liability: up to $3,000,000
• Comprehensive and Collision: up to $80,000
• Deductible: $1,500 (trucks) / $2,000 (RV)
8. Security Deposit
A refundable security deposit of $1,500 CAD is required on or
before pick-up day. The deposit, or any remaining balance after deductions,
will be returned within 7 business days of drop-off via the original payment
method.
9. Mileage
200 km/day is included in the rental price. Any distance
beyond this allowance will be charged at $0.45/km.
10. Fuel
The vehicle runs on 87 Gasoline. The Renter must return the
vehicle with a full tank. If the tank is not topped up, the Owner will fill it
and charge the Renter for the fuel plus a $50 refuelling fee.
If the wrong fuel type is used, the Renter is fully
responsible for any resulting damage.
11. Tolls, Fines & Violations
The Renter is responsible for all tolls, parking tickets,
traffic violations, and any associated fines, penalties, or administrative fees
incurred during the Rental Period.
12. Interior Damage & Equipment
The Renter is fully responsible for any damage to the interior
or equipment, including appliances, the rooftop tent, awning, fridge, and
kitchen setup. Repair or replacement costs will be deducted from the security
deposit.
In the event of theft, the Renter is responsible for the cost
of all equipment and appliances provided by the Owner.
13. Smoking
Smoking is not permitted in or around the Rental. Any smoke
odour detected upon return will result in a $300 cleaning fee.
14. Cancellation Policy
More than 30 days before pick-up: Full refund of the deposit
paid (50% of total rental price, less insurance, cleaning fee, and 3% card
processing fee).
Between 14 and 30 days before pick-up: 50% of the total rental
amount will be charged.
14 days or less before pick-up: The full rental amount
applies. No refund.
Note: 3% card processing fees are non-refundable in all cases.
15. Waiver of Liability
The Owner is not responsible for any personal items left in
the vehicle. The Renter assumes all risk for theft, loss, or damage to personal
belongings during the Rental Period.
16. Chainsaw Usage Waiver
Where a chainsaw is included with the rental, the Renter
acknowledges the following:
Assumption of Risk
The Renter is fully aware that operating a chainsaw carries
inherent risks, including serious injury, kickback, hearing damage, and hazards
from falling debris.
Safety Guidelines
The Renter agrees to:
• Wear appropriate protective equipment at all times (goggles, hearing
protection, gloves, sturdy clothing)
• Verify the chainsaw is in good working order before use
• Not operate the chainsaw in hazardous weather conditions
• Keep all bystanders at a safe distance during operation
Release of Liability
TakeMeOverland Ltd., its officers, employees, and agents are
released from any and all claims, damages, or losses arising from the Renter’s
use of the chainsaw. The Renter agrees to indemnify and hold TakeMeOverland
Ltd. harmless from any liabilities, costs, or legal fees resulting from
chainsaw use.
In an emergency, the Renter must cease operation immediately
and contact emergency services if required.
By completing a reservation, the Renter confirms they have
read, understood, and agreed to this Chainsaw Usage Waiver, and accepts sole
responsibility for their safety and the safety of others while operating the
chainsaw.
