Rental Agreement

RENTAL AGREEMENT

This Agreement (“Agreement”) is made by and between the Renter and the Owner (“Owner”) for the rented Vehicle (the “Rental”).

The Renter and Owner have read and agree to the terms and conditions of this Rental Agreement and thereby give their consent to the Agreement and acknowledge that by reserving the camper truck that Renter is the designated primary driver and will take full responsibility for any damage or incidents occurring during the rental period.

Renter agrees that Owner shall always have a superior right of possession of the Rental over Renter. In the event that Owner, in its sole and absolute discretion, determines the Rental is at risk of damage or loss, Owner shall have the absolute right to recover the Rental from Renter regardless of the amount of time remaining in the Rental Period. In the event Owner recovers a Rental from Renter, in addition to those costs payable pursuant to other parts of this Agreement, Renter shall pay all costs associated with such recovery including, but not limited to travel costs, fuel and repairs.

Rental Period. The “Rental Period” begins when the Owner provides the Renter with the keys, and turns over possession, custody and control of the Rental to the Renter. The Rental Period ends upon the completed return of the Rental to the Owner.

Drivers. This vehicle may only be driven by an authorized driver, 25 years of age or over. An authorized driver is the renter and any other additional approved driver(s) provides their driver’s license and has agreed to this Rental Agreement. All authorized drivers must satisfy age requirements, have the valid driver's license and provide a physical street resident address.

Renter acknowledges that the camper truck can handle differently from passenger cars. The Rental requires more skill and expertise to operate safely than a passenger car rental. For example, the Rental may require more clearance above, in front of, behind, and beside them to safely operate, and the use of mirrors and direct visual verification are always required to maintain knowledge of the location of adjacent vehicles and obstacles on the roadway. Additional weigh to the truck such roof top tent, camping gear, larger tire size may extend the braking trajectory and must be taken into consideration to drive safely.

Departure Policy. Owner shall ensure that the Rental truck is clean on the interior and exterior and is in a safe and roadworthy condition. Owner acknowledges that it is their responsibility to inform Renter of the limitations of their Rental, including clearance heights and widths and other operating instructions. At the time of pick up, an orientation of the truck will be provided by the Owner as well as an obligatory driving lesson.

When accepting the Rental, Renter and Owner, or authorized representative of Owner, will complete and sign the Departure Form for the Rental, noting in writing and/or time stamped photos, digitally or electronically, any and all defects or damage to the Rental prior to Renter's acceptance of same.

Return Policy. Renter agrees to return the truck no later than as mutually agreed to by the Owner.

A fee of $100 will be charged if returned later than on agreed time.

Upon return of the Rental, Renter and Owner, or authorized representative of Owner, must

document the condition of the Rental via photos up to 24 hours before the trip starts and

no later than 48 hours after the trip ends. This is a requirement for insurance coverage.

Condition of Rental & Responsibility for Repair. In the event of any loss or damage to the Rental, or any personal property or bodily injury claim that occurs during the Rental Period due to any cause regardless of fault, including, but not limited to, collision, rollover, theft, vandalism, seizure, fire, flood, wind, hail or other acts of nature or God, Renter is responsible and is required to pay up to the deductible outlined in the insurance of the truck.

Prohibited Use of the Rental. The Renter and Permitted Drivers shall not drive in a careless, negligent, reckless or unlawful manner. Renter agrees to only operate the Rental on public roadways with sufficient width and height clearance to allow the Rental to be operated safely and without damage. Maximal allowed speed is 80 km/h.

Tolls, Fines, Expenses, Costs and Administrative Fees. Renter agrees to report to the Owner and pay for all tolls and tickets (including for parking and moving or stationary traffic violations) incurred during the Rental Period. Renter agrees to pay or reimburse Owner for all fines, penalties, interest, and court costs for parking, traffic, toll and other violations, including storage liens and charges incurred as a result of the rental.

Insurance. Third Party Liability, Comprehensive and Collision Insurance is provided during the rental provided by ICBC (government insurance of BC, Canada)

Third party Liability: up to $3 000 000

Comprehensive and Collision: up to $80 000

Deductible: $1500 ($2000 RV)

Repair Claim Responsibility Clause
In the event of a repair claim, the renter agrees to bear full financial responsibility for:

- The total cost of the repair.

- Additional expenses incurred by the owner, including but not limited to:

Compensation for the owner's time at $50 per hour.

Applicable taxes.

Fuel costs and other related expenses.

Smoking. No smoking is allowed in the Rental. Smoke odors in returned Rental will result in additional fees $300.

Interior Damage and Equipment Renter is fully responsible for any and all damages to the interior and equipment of the Rental, including the damage of appliances, Roof top tent, awning, fridge, bed kitchen setup etc Any damage cost will be deducted from security deposit.

In case of a theft the renter is responsible to cover the cost off all the equipment including the appliances provided by the owner including the damage.

Security deposit. The refundable security deposit of $1500 is required to be paid together with the full rent price prior the start of the rent. The security deposit or its part will be refunded within 7 business days from a day that the camper was dropped off via the same method of payment.

Cancelation policy. If cancelled by the Renter more than 30 days from the date of rental: The renter will receive a full* refund of the deposit that was paid (50% fee of the total price plus insurance and cleaning fee, 3% credit card fees will be deducted from the total deposit paid).

* credit card fees are deducted from this amount.

If cancelled by the Renter between 30 days and 14 days from the date of rental: The owner will charge 50% of the rental amount. If cancelled by the Renter 14 days or less from the date of rental: The full rental amount will apply.

Mileage allowance. The mileage of 200 km / day is included in the rental price. If the allowance is exceeded the additional mileage will be charged out at $0.45/km.​

Fuel Policy. The renter is responsible for fueling up the rented vehicle with the correct type of fuel 87 Gasoline. If renter fills the vehicle with the wrong type of fuel, renter is fully responsible for damages that occur as a result. The renter must top-up the tank before the return. If renter returns truck having not filled or topped-up the tank, the Owner will fill up the tank and provide the renter with the fuel receipt to be paid plus 50$ refill fee.​

Waiver of liability.

Renter is responsible for all personal contents left in the vehicle at all times. Any theft, loss or damage of any and all personal items are not the responsibility of the Owner.

CHAINSAW USAGE WAIVER

I, hereby acknowledge that I have been informed of the inherent risks and potential dangers associated with the operation of a chainsaw. In consideration of being allowed to use the chainsaw provided by takemeoverland.com.

I willingly agree to the terms and conditions outlined in this waiver.

**Assumption of Risk:**

I am fully aware that operating a chainsaw involves inherent risks, including but not limited to:

1. Serious injury, including lacerations and amputations.

2. Personal injury resulting from kickback, loss of control, or improper use.

3. Exposure to loud noise levels, which may lead to hearing damage.

4. Potential hazards from falling branches, debris, or other objects.

**Safety Guidelines:**

I agree to abide by all safety guidelines and instructions provided by [Owner/Organization Name] for the proper and safe operation of the chainsaw. This includes, but is not limited to:

1. Wearing appropriate personal protective equipment, including safety goggles, hearing protection, gloves, and sturdy clothing.

2. Ensuring that the chainsaw is in good working condition before operation.

3. Refraining from operation in hazardous weather conditions, such as heavy rain or strong winds.

4. Keeping bystanders and other individuals at a safe distance while the chainsaw is in use.

**Release of Liability:**

I understand and accept that www.takemeoverland.com shall not be held liable for any injuries, damages, or losses that may occur as a result of my use of the chainsaw. I hereby release www.takemeoverland.com, its officers, employees, and agents from any and all claims, demands, actions, or causes of action arising out of or in connection with the use of the chainsaw.

**Indemnification:**

I agree to indemnify and hold harmless www.takemeoverland.com from any and all liabilities, costs, expenses, and attorney fees arising from my use of the chainsaw.

**Emergency Procedures:**

In the event of an emergency, I will immediately cease operation of the chainsaw and follow established emergency procedures. I understand the importance of contacting emergency services if necessary.

**I have read, understand, and agree to the terms of this Chainsaw Usage Waiver. I acknowledge that I am solely responsible for my safety and the safety of others while using the chainsaw.**
